USA is a typical destination for international college students, and now they’re also allowed to work for 3 years after finishing their education in the USA.

Below are some visa rules to study and work within the USA:

  • Employers participating in STEM OPT should incorporate a proper training program that features concrete studying objectives with correct oversight.
  • Employers and college students should report material changes of their training program.
  • To guard against adverse effects on U.S. workers, terms and conditions of a student’s training opportunity – reminiscent of duties, hours, and compensation – have to be on par with U.S. workers in similar positions in the identical geographic space of employment. Moreover, the scholar should not replace a full-time, part-time, temporary, or permanent U.S. employee.
  • Only students who earned a level from a school accredited by a U.S. Department of Education-recognized accrediting company and certified by SEVP might apply for a STEM OPT extension.
  • Participating students who obtain a further qualifying degree from an accredited school or college can apply for a second STEM OPT extension.
  • Participating college students can use a previously-earned qualifying degree to apply for a STEM OPT extension.
  • The prior degree should not have already formed the basis of a STEM OPT extension and have to be from a school accredited by a U.S. Department of Education-recognized accrediting agency and certified by SEVP on the time of the scholar’s STEM OPT application.
  • The student’s most recent degree should also be from an accredited and SEVP-certified institution.
  • All STEM OPT employers should participate in DHS’ E-Verify program.
  • To qualify, college students should work a minimum of 20 hours per week per employer.
  • College students are permitted a limited period of unemployment throughout the initial period of post-completion OPT, and the STEM OPT extension.
